These General Purchase Terms and Conditions govern the electronic contracting of products offered by ARTCAVA through its website. By placing an order, the customer fully accepts these terms. We recommend reading the following sections carefully before making a purchase. <\/p>\n\n
1. Product information and prices Product prices are displayed in euros (\u20ac) and include the applicable Value Added Tax (VAT), unless otherwise stated. Any other taxes or additional charges (e.g. shipping costs) will be indicated before completing the purchase. ARTCAVA reserves the right to modify prices at any time; however, the rates in effect at the time the order is placed will be charged to the customer. In the case of international sales or sales to territories with special tax regimes, the final order price may vary depending on the taxes and duties applicable at the destination. Offers or promotions will be duly marked as such, indicating the previous price and the offer price, and will be valid for the period specified. <\/p>\n\n
2. Order process To purchase from the ARTCAVA website, you must add the desired products to the cart and follow the online purchase process. Personal data required to process the order will be requested (name, address, email, payment details, etc.). Before completing the purchase, the customer must verify that the information provided is correct and expressly accept these Purchase Terms and the Privacy Policy. Once payment is completed, ARTCAVA will send an order confirmation email to the customer, which will serve as proof of purchase. If you do not receive the confirmation email, please check your spam folder or contact us. <\/p>\n\n
ARTCAVA reserves the right to reject an order, duly notifying the customer, in exceptional cases such as: out-of-stock or discontinued product, obvious error in the displayed price, suspicion of fraud, or if the customer breaches these terms. In such cases, if payment has already been processed, ARTCAVA will refund the full amount immediately using the same payment method. <\/p>\n\n
3. Payment Orders must be paid using the payment methods accepted on the website. Currently, credit\/debit cards (Visa, Mastercard, etc.) and other secure electronic payment methods such as PayPal are accepted. When selecting a payment method, you may be redirected to the secure payment gateway of the corresponding provider. All transactions are transmitted encrypted using secure protocols (SSL) to ensure data confidentiality. ARTCAVA will not have access to sensitive banking details (such as the full card number) provided on these external payment platforms. The charge will be made at the time of purchase or shortly afterwards, depending on the method selected. If payment is declined, the order will not be processed. <\/p>\n\n
4. Shipping and delivery ARTCAVA ships primarily within Spain (mainland and Balearic Islands). For shipments to the Canary Islands, Ceuta, Melilla, or other EU countries, please check availability and costs before placing your order (restrictions or additional customs charges may apply). Shipments to PO boxes are not available. Shipping costs will be clearly indicated during the purchase process, before completing the order. <\/p>\n\n
Estimated delivery times are 2 to 5 business days for mainland Spain shipments, and may vary for other destinations. Delivery times are approximate; ARTCAVA works to meet them, but is not responsible for delays caused by transport incidents or circumstances beyond its control (e.g. strikes, local public holidays, customs procedures for international destinations, etc.). If a significant delay in the shipment of an order is anticipated, we will inform the customer as soon as possible and give them the option to keep the order or cancel it with a full refund. <\/p>\n\n
Delivery will be considered completed at the moment the carrier makes the product available to the customer, which is confirmed through the carrier’s control system (e.g. signature upon receipt). If the customer is absent at the time of delivery, the carrier will make contact (usually by note or email\/SMS) to arrange a second delivery attempt. If after repeated attempts delivery is not possible, the package may be returned to ARTCAVA; in such case, we will contact the customer to decide on a resolution (a new shipment \u2014 with possible additional charges \u2014 or cancellation of the order). <\/p>\n\n
Upon receiving the package, the customer must check the condition of the goods in the presence of the carrier. If the package appears to be externally damaged or there are signs of possible deterioration of the contents, it is important to note the issue in writing on the carrier’s delivery record (“damaged package”, etc.) and notify ARTCAVA as soon as possible. We will handle any incidents involving products damaged during transport. <\/p>\n\n
5. Right of withdrawal (purchase returns) If you have purchased as a consumer (personal use, not a business), you have the right to withdraw from the sales contract without giving any reason, within 14 calendar days from receipt of the product. To exercise the right of withdrawal, you must notify us of your decision unambiguously (for example, by sending an email to info@artcava.com stating the order number and the product to be returned). Once your request is received, we will reply with return instructions (shipping address, etc.). <\/p>\n\n
The customer must return the products to ARTCAVA without undue delay and, in any case, within a maximum period of 14 calendar days from the date on which they communicate their decision to withdraw. The deadline is considered met if the goods are returned before the end of this period. The direct costs of the return (return shipping costs) will be borne by the customer, unless the return is due to a product defect (see section 6). We recommend returning items using a service that provides tracking or proof of delivery.. <\/p>\n\n
Once the returned products have been received and verified to be in proper condition, ARTCAVA will refund all payments received for the purchase, including, where applicable, the initial shipping costs (the standard shipping cost will be refunded, but not any additional costs if an express or priority delivery was chosen). The refund will be made using the same payment method used by the customer in the original transaction, unless expressly agreed otherwise, and within a maximum of 14 calendar days from the date on which we were informed of the withdrawal decision. We may withhold the refund until we have received the goods or until the customer has provided proof of return, whichever comes first. <\/p>\n\n
Return conditions: Only products that are in their original condition, unused and unsealed, and retaining their original packaging and labels will be accepted for return. Excluded from the right of withdrawal are goods that may deteriorate or expire rapidly, sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery, as well as other exceptions provided for in Article 103 of the General Law for the Defence of Consumers and Users. In particular, returns of wine bottles that have been opened or tampered with will not be accepted (the product must not have been uncorked or partially consumed), nor will returns of products that are not returned complete with all their elements (accessories, promotional gift if included, etc.). <\/p>\n\n
For returns of special orders or personalised products (for example, bottles with custom labels, bespoke orders for events), withdrawal is not permitted once production has been confirmed, given the personalised nature of the product, unless there are manufacturing defects. <\/p>\n\n
6. Exchanges, incidents, and defective products If you receive a product different from the one ordered, or a product with damage or manufacturing defects (for example, wine with a cork taint \u2014 TCA), please contact us as soon as possible (preferably within 14 days of receipt) and describe the problem. ARTCAVA will offer the appropriate solution, which may consist of a replacement with an identical product in proper condition (at no additional cost) or a refund of the amount paid, as applicable. In the case of a defective product, return shipping costs will be borne by ARTCAVA and we will arrange collection of the defective product at no cost to you. We may ask you for photographs or other evidence of the fault and request that you keep the item and its original packaging until the incident is resolved. <\/p>\n\n
ARTCAVA is liable for any lack of conformity that becomes apparent within 3 years of delivery, under the terms provided by law. In the case of defective products, the consumer has the right to repair, replacement, price reduction, or contract termination, in accordance with Royal Legislative Decree 1\/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users. Where possible, we will first opt for repair or replacement; if these are not feasible or are disproportionate, a price reduction or refund will be offered, in accordance with applicable regulations. These processes will be free of charge for the consumer. Please note that this legal guarantee does not cover normal wear and tear or damage caused by misuse or improper handling of the product. <\/p>\n\n
7. Customer service For any incident, complaint, or exercise of rights, the customer may contact ARTCAVA at info@artcava.com. This contact may also be used for queries related to products or the purchase process. We will endeavour to respond within 24\u201348 hours on business days. <\/p>\n\n
8. Amendments to these terms These Purchase Terms may be updated or amended by ARTCAVA from time to time (for example, to adapt to legal changes or service improvements). The new terms will be effective from the date of publication on the website and will apply to transactions made after that date. We recommend reviewing these terms periodically. In any case, orders confirmed before any change will be governed by the terms in effect at the time of contracting. <\/p>\n\n
9. Applicable law and jurisdiction Purchases made through this website are subject to Spanish law. In the event of any conflict or discrepancy in the interpretation or application of these contractual terms, the parties submit, expressly waiving any other jurisdiction, to the courts and tribunals corresponding under applicable consumer and user legislation, typically those of the consumer’s place of residence. If the purchase is made by a legal entity (company), both parties agree to submit to the courts and tribunals of Barcelona, waiving any other jurisdiction that may apply. <\/p>\n\n
By making a purchase at ARTCAVA, the customer declares that they are over 18 years of age, in accordance with current legislation prohibiting the sale of alcohol to minors.
